To receive a contract award, your firm must be registered in www.sam.gov. Please note that on June 29, 2018, the initial registration and annual renewal process has changed. The new process is a more robust and lengthy process which includes submitting a notarized letter formally appointing an Entity Administrator. Please see process below:

The Small Business Act (15 U.S.C. 631, et seq.) does not apply to contracts solicited within the Expeditionary District. The Small Business Administration’s small business programs are governed by the Federal Acquisition Regulations Part 19, which applies only within the United States. However, we encourage prime contractors to use qualifying U.S. and local national small businesses to the maximum extent practicable. The District also encourages small businesses to submit proposals on open solicitations; some small business have successfully competed and received prime contracts.

Specific Authority for Afghan Procurements under the National Defense Authorization Act of 2008  

Section 886 of Public Law 110-181 allows procurements using other than full and open competition for Acquisitions in support of Operations in Iraq and Afghanistan. Contracts are procured using other than competitive procedures to award a contract to a particular source or sources from Afghanistan per DFARS clause 252.225-7026, Acquisition Restricted to Products or Services from Iraq or Afghanistan. We solicit quotes/proposals from offerors deemed to be a “source from Afghanistan,” as defined by DFAR 225-7001 – Product from Afghanistan means a product that is mined, produced, or manufactured in Afghanistan. Service from Afghanistan means a service including construction that is performed in Afghanistan predominantly by citizens or permanent resident aliens of Afghanistan. A source from Afghanistan means a source that:

(1) Is located in Afghanistan,

(2) Offers products or services from Afghanistan.

All sources from Afghanistan:

(1) Will be registered in the Joint Contingency System (JCCS): https://www.jccs.gov  

(2) Obtain and submit a copy of their Domestic Investment License issued by the Afghanistan Investment Support Agency (AISA): http://www.aisa.org.af or Ministry of Commerce & Industries (MoCI) License: http://moci.gov.af/en.

(3) Must register on System for Award Management (SAM) at https://www.sam.gov. Offerors must have and must maintain an active registration.

(4) Must have ready a Contractor Qualifications Financial Standing Questionnaire with answers to the following questions:

(a) Does the offeror have an active account with their financial institution?

(b) How long has this account been active?

(c) What is the offeror average balance (in digits only)?

(d) How many returns (insufficient funds) has the offeror had in the last 12 months?

(e) How many loans does the offeror currently have outstanding?

(f) Has the offeror been able to meet his financial obligations in time?

(g) Does the offeror have a line of credit? If so, what is that amount (digits only)?

(5) Once registered, look on https://www.fbo.gov/index?s=main&mode=list&tab=list for opportunities in Afghanistan.

Note: The financial questionnaire must be completed by the offeror’s financial institution. On every proposal submitted to the U.S. Army Corps of Engineers (USACE), the financial banking institution will complete and email the completed financial questionnaire to the Contracting Officer or Contract Specialist in the USACE solicitation. The completed financial questionnaire must be affixed with the financial institution seal and signature of the referenced individual on the questionnaire.
